Welcome to ThemeTidy. These Terms & Conditions govern your use of the ThemeTidy website, ThemeTidy Framework, digital products, downloads, services, documentation, and related offerings.
By accessing our website, purchasing a product, downloading the ThemeTidy Framework, or using our services, you agree to these Terms & Conditions. If you do not agree with these Terms, please do not use our website or purchase our products.
1. About ThemeTidy
ThemeTidy provides Shopify-focused digital products, frameworks, documentation, development resources, and professional e-commerce services.
For legal and commercial purposes, “ThemeTidy,” “we,” “us,” and “our” refer to the business operating the ThemeTidy website and its products.
2. ThemeTidy Framework
ThemeTidy Framework is a digital Shopify development framework intended to provide a reusable foundation for building and customizing Shopify storefronts.
The Framework is licensed to you and is not sold to you as a transfer of ownership of the underlying intellectual property.
Your license gives you the right to use the Framework according to the license type you purchased.
3. License Types
Single Store License
A Single Store License permits use of the ThemeTidy Framework on one Shopify store.
You may customize the Framework for that store and use it as part of that store’s development.
You may not use the same license simultaneously on additional Shopify stores.
Agency License
An Agency License permits use of the ThemeTidy Framework on multiple Shopify stores, subject to the terms of the Agency License and any applicable restrictions stated at the time of purchase.
The Agency License is intended for agencies, developers, freelancers, and teams working on multiple client or merchant stores.
Custom Store Build
A Custom Store Build is a professional implementation service using the ThemeTidy Framework.
The scope, deliverables, timeline, pricing, revisions, support period, and other project terms may be agreed separately in writing.
A Custom Store Build does not automatically grant unrestricted rights to redistribute or resell ThemeTidy Framework source files.
4. Permitted Use
You may:
Install and use the ThemeTidy Framework according to your purchased license.
Customize the Framework for your own Shopify store or authorized client projects.
Modify theme files and extend the Framework through Liquid, CSS, JavaScript, and other permitted Shopify technologies.
Use the documentation and resources provided with your purchase for legitimate development and implementation purposes.
5. Prohibited Use
You may not:
Resell, sublicense, redistribute, publish, or publicly share ThemeTidy Framework files as a standalone product.
Make the Framework or substantial portions of it available for free download.
Claim ownership of ThemeTidy’s original source code, branding, documentation, or intellectual property.
Create a competing framework, theme marketplace product, or downloadable product based substantially on ThemeTidy source files.
Share purchase credentials or protected download links for the purpose of allowing unauthorized users to obtain the product.
Use the product for unlawful, fraudulent, or abusive activities.
6. Intellectual Property
ThemeTidy and its licensors retain all rights, title, and interest in the ThemeTidy Framework, documentation, branding, website content, graphics, code, and other original materials except for materials owned by third parties.
Purchasing a license gives you a right to use the product under these Terms. It does not transfer intellectual property ownership to you.
You retain ownership of your own store content, branding, product data, media, and other materials that you independently provide.
7. Updates
ThemeTidy may release improvements, bug fixes, compatibility updates, performance improvements, documentation updates, and new Framework versions.
Where your purchased license includes ongoing Framework updates, those updates are provided according to the applicable license terms.
ThemeTidy aims to maintain compatibility with supported Shopify functionality, but cannot guarantee compatibility with every third-party Shopify app, integration, browser, custom script, or future platform change.
Shopify controls its own platform and may change APIs, features, policies, or technical requirements at any time.
8. Support
Support is provided according to the support level included with your purchased plan.
Support may include:
Installation guidance
ThemeTidy Framework questions
Bug reports
Documentation assistance
Troubleshooting of Framework-related issues
Support does not automatically include unlimited custom development, third-party app debugging, bespoke design work, or changes unrelated to ThemeTidy.
Custom implementation work may be quoted separately.
9. Custom Services
Custom development, store setup, migration, optimization, UX work, conversion work, or other professional services may be offered separately from the Framework license.
Project work may be subject to a separate scope, quotation, agreement, timeline, payment schedule, and delivery terms.
10. Payments
Purchases made through our online checkout may be processed by Paddle, which acts as the Merchant of Record for transactions processed through its platform. Paddle may handle order processing, payment collection, taxes, invoicing, and related buyer support for those transactions.
You are responsible for providing accurate billing and contact information during checkout.
11. Refunds and Cancellations
ThemeTidy does not offer an unconditional “30-day money-back guarantee” unless a specific offer explicitly states otherwise.
Refund requests for purchases processed through Paddle are handled in accordance with the applicable Paddle refund rules, these Terms, and applicable consumer protection laws.
Certain consumers may have statutory cancellation or withdrawal rights depending on their country or region. For digital products, those rights may be affected when downloading, accessing, or using the digital product where applicable legal requirements have been met.
If you experience a genuine technical problem with a ThemeTidy product, please contact support and give us a reasonable opportunity to investigate and help resolve the issue.
12. Downloads and Digital Delivery
After successful payment, digital products may be delivered through the purchase platform, customer account, email, download area, or another delivery method specified at checkout.
You are responsible for maintaining access to the email address and account associated with your purchase.
You must not share protected download links or credentials with unauthorized users.
13. Third-Party Services
ThemeTidy may work alongside Shopify, Shopify apps, payment providers, analytics tools, hosting providers, and other third-party services.
Third-party services have their own terms, policies, APIs, and compatibility requirements.
ThemeTidy does not control third-party services and cannot guarantee continued compatibility with every third-party service.
14. Disclaimer
ThemeTidy provides digital products and services on an “as available” basis.
We make reasonable efforts to provide reliable, functional, and well-maintained products, but we do not guarantee that:
The product will be uninterrupted or error-free.
The product will work with every third-party app or integration.
Shopify will not change functionality that affects the product.
A specific business, revenue, ranking, conversion, traffic, or performance result will be achieved.
Any examples, case studies, performance figures, or business outcomes shown on our website are examples of observed results and are not guarantees of future results.
15. Limitation of Liability
To the maximum extent permitted by applicable law, ThemeTidy will not be responsible for indirect, incidental, special, consequential, or business losses arising from your use of our products or services.
This may include loss of profits, sales, data, business opportunities, or goodwill.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, services, policies, or legal requirements.
When material changes are made, we may update the “Last updated” date on this page.
Your continued use of ThemeTidy after updated Terms are published constitutes acceptance of the updated Terms to the extent permitted by law.
